   It is an offence of voluntarily causing hurt under section 323 of the Penal Code punishable with imprisonment for term which may extend to one year, or fine of two thousand ringgit, or both.

   Whoever does any act with the intention of thereby causing hurt to any person, or with the knowledge that he is likely to cause hurt to any person, and does thereby cause hurt to any person, is said “voluntarily to cause hurt”.

   Since it is a summons case, the police has to get an Order to Investigate (OTI) from a deputy public prosecutor to investigate the case.

   Shame on Penghulu who is appointed and trusted by the government to look after after his `anakbiaks` and set a good example to others, took the law into his own hands.

   The case was highlighted in the Borneo Post on November,12,2009.

   It was reported that Ipoi Jau, 66, a folk from a Long Terawan longhouse in Miri was punched by a penghulu from Tutoh Apoh when the former asking a question related to commission from logging activities within the longhouse`s territory.

   As a result of the assault, Ipoi Jau sustained a two centimeter vertical cut between his eyes.

   Based on the police report above, it was an act of an irresponsible penghulu who took the law into his own hand without provocation. The reaction of longhouse dwellers to such a leadership style is often of fear, resentment, resistance and frustration. A Temenggong, pemancha, penghulu and tuai rumah should show good example of a leader in community affair and interest, stimulates rapport, understanding and tolerance.

   Idiot, stupid or stupidity at its lowest are the best words i can described of the penghulu. You got no respect to the rakyat and especially the elder.

   My advise to you, mr. penghulu, take along a bottle a paraquat, go deep in the jungle or tied yourself to your balak, have a deep thought and commit suicide.
